Overview
Welcome to better talks. The terms “we”, “us” and “our” refer to better talks. better talks operates this online shop and this website, including all associated information, content, features, tools, products and services (collectively, the “Services”).
The following General Terms and Conditions (“AGB”) govern the rights and obligations relating to the use of our Services and the purchase of our products.
By visiting, using or placing an order via our Services, you agree to these AGB and our Privacy Policy. If you do not agree, you may not use our Services.
1) Scope, Definitions
(1) These AGB apply to all orders placed via the better talks online shop by consumers and business customers (collectively “Customers”).
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity (Section 13 of the German Civil Code (BGB)).
(3) An entrepreneur is a natural or legal person or a partnership with legal capacity who, at the time of concluding the contract, is acting in the course of their commercial or self-employed professional activity (Section 14 of the German Civil Code (BGB)).
(4) Any deviating terms and conditions of the customer shall not be recognised unless we expressly agree to their validity in writing.

3) Services, Product Descriptions
(1) We sell, in particular, physical products (e.g. conversation, game or question cards, books and accessories).
(2) Product images are for illustrative purposes only. Colours and appearances may vary depending on the screen, device or settings.
(3) The product description at the time of ordering shall be decisive.
4) Conclusion of contract in the online shop
(1) The presentation of products in the shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
(2) By clicking the “Buy now” or “Place order” button, you are making a binding offer to conclude a purchase contract.
(3) The automated order confirmation by email does not yet constitute acceptance of the offer.
(4) The contract is concluded as soon as we expressly accept the offer, dispatch the goods, or at the latest upon delivery of the goods.
(5) We reserve the right to refuse orders for valid reasons (e.g. unavailability of the goods).
5) Contract language, contract text
(1) The contract language is German.
(2) The order details and these Terms and Conditions will be sent to you by email. The Terms and Conditions can be viewed in the shop at any time.
6) Price information
(1) All prices quoted in our online shop within the EU are gross prices including statutory VAT. For orders outside the EU, net prices are quoted. Errors, misprints and price changes are reserved. Deliveries to an address outside the EU may be subject to import duties and taxes, which become payable upon arrival of the delivery at the delivery address.& nbsp;
(2) Delivery charges are stated in our price listings in our online shop. The price, including VAT and any applicable delivery charges, is also displayed in the order form before you submit your order.
7) Payment methods
(1) The payment methods offered at checkout are available (e.g. credit card, PayPal, Apple Pay, Google Pay, Klarna – subject to availability).
(2) The purchase price is due upon conclusion of the contract, unless otherwise agreed.
(3) Costs arising from chargebacks or returned direct debits for which the customer is responsible may be passed on.
8) Delivery & Transfer of Risk
(1) Delivery shall be made to the delivery address provided by the customer.
(2) Delivery times are non-binding unless they are expressly marked as binding.
(3) Consumers: The risk of accidental loss or deterioration of the goods passes to the customer upon handover of the goods.
(4) Businesses: The risk passes to the transport company upon handover of the goods.
(5) If a consignment is returned due to incorrect address details or refusal of acceptance, we reserve the right to charge the costs of re-dispatch, provided the customer is responsible for this.
9) Retention of title
The goods remain our property until full payment has been received.
10) Right of withdrawal & returns
(1) Consumers are entitled to a statutory right of withdrawal.

(3) Return costs: In the event of a valid cancellation, the buyer shall bear the direct costs of returning the goods, unless otherwise specified in the cancellation policy.
(4) Returns must be made via the designated returns process: Link to Returns. Returns made outside the scope of the right of withdrawal or not via the designated process may be excluded from acceptance.
11) Warranty
(1) The statutory rights regarding liability for defects apply.
(2) Business customers are obliged to inspect the goods immediately and to notify us of any obvious defects in writing within a reasonable period. Statutory obligations to give notice of defects remain unaffected.
12) Liability
(1) We shall be liable without limitation in cases of intent, gross negligence and for damage resulting from injury to life, limb or health.
(2) In cases of simple negligence, we shall only be liable for breaches of material contractual obligations (cardinal obligations) and limited to foreseeable damage typical for the contract.
(3) Mandatory statutory liability provisions remain unaffected.
13) Intellectual Property
All content on the shop (texts, designs, graphics, product concepts, photos, trademarks) is protected by copyright and trademark law. Any use beyond private use is not permitted without our prior consent.
14) Reviews Feedback
(1) By submitting reviews or feedback, you warrant that no third-party rights are infringed.
(2) You grant us the right to use this content for shop and communication purposes without any time or geographical restrictions.
(3) We reserve the right to remove content in the event of legal violations.
15) Prohibited Use
The use of the shop for unlawful purposes, to compromise security or to infringe the rights of third parties is prohibited.

17) Consumer Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
18) Final Provisions
(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) For business customers, the place of jurisdiction is the registered office of the company.
(3) Should any provision be invalid, the validity of the remaining provisions shall remain unaffected.
19) Technical note (Shopify)
The shop is technically operated via Shopify. The contractual partner for all orders remains exclusively Amtenbrink & von Studnitz GbR.
